These Terms and Conditions (the "Terms") govern your use of the Touchgeorgia website and the purchase of any tour packages or services (the "Services") offered by Touchgeorgia (referred to as "we," "us," or "our"). By accessing our website, booking any tour, or using our Services, you agree to be bound by these Terms.
1. Booking and Confirmation
• 1.1. Agreement: A booking is considered confirmed only after we have received the required payment (deposit or full payment, as specified for the particular tour) and you have received a written confirmation (e.g., via email) from Touchgeorgia.
• 1.2. Accuracy of Information: The client is responsible for providing accurate and complete information, including names, contact details, and any necessary special requirements (e.g., dietary restrictions, medical conditions) at the time of booking. Touchgeorgia is not liable for issues arising from inaccurate information provided by the client.
• 1.3. Pricing: All prices are quoted in [Specify Currency, e.g., USD, EUR, GEL] unless otherwise stated. Prices may be subject to change without notice until a booking is confirmed. Once confirmed, the price is generally fixed, except for changes resulting from government taxes, fees, or exceptional circumstances beyond our control.
2. Payment

3. Changes and Amendments by the Client
• 3.1. Client Amendments: If you wish to make changes to your confirmed booking, you must notify Touchgeorgia in writing as soon as possible.
• 3.2. Amendment Fees: Touchgeorgia will endeavor to accommodate amendment requests. An administrative fee of [Specify amount/percentage, e.g., $50 per change] may apply, in addition to any charges incurred by suppliers (e.g., hotels, transport providers) due to the change.

4. Cancellation and Refunds
• 4.1. Cancellation by the Client: All cancellations must be received by Touchgeorgia in writing (email is acceptable). The date of receipt of the written cancellation notice will determine the cancellation charges applicable.
• 4.2. Cancellation Charges: The following cancellation charges apply (based on the total tour price):

• 4.3. No Show: Failure to join a tour, arrive on time, or utilize any part of the booked services is considered a "No Show," and no refunds will be provided.
5. Changes and Cancellation by Touchgeorgia
• 5.1. Minor Changes: Touchgeorgia reserves the right to make minor changes to the itinerary, accommodation, or transport arrangements at any time due to unforeseen circumstances, operational needs, or local conditions. We will inform you of any changes as soon as possible.
• 5.2. Significant Changes: If we are forced to make a significant change to your confirmed booking (e.g., a change of date, a major change to the itinerary, or a lower standard of accommodation), you will be notified promptly and offered one of the following options:
• Accept the change.
• Accept an alternative tour package of comparable standard (if available).
• Receive a full refund for the cancelled portion of the tour.
• 5.3. Force Majeure: Touchgeorgia is not liable for any delays, non-performance, or cancellation of a tour due to events outside our reasonable control, including but not limited to war, civil unrest, terrorist activity, industrial disputes, natural disasters, epidemics, or government restrictions (Force Majeure). In such cases, we will offer a credit towards a future tour or a refund, minus any unrecoverable costs incurred by us.
6. Responsibility and Liability
• 6.1. Limitation of Liability: Touchgeorgia acts only as an agent for the providers of transportation, accommodation, and other services. We assume no responsibility for any injury, loss, damage, accident, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or through the acts or defaults of any company or person engaged in carrying out the tour.
• 6.2. Maximum Liability: In the event of a breach of these Terms, Touchgeorgia's liability to the client is limited to the total price paid by the client for the specific tour package, except where prohibited by mandatory local law.
• 6.3. Client Conduct: Clients agree to comply with the instructions of the tour guide/leader and local laws in Georgia. Touchgeorgia reserves the right to terminate a client's participation in a tour without refund if the client's behavior is disruptive, illegal, or compromises the safety or enjoyment of other participants or staff.
7. Travel Insurance
• 7.1. Mandatory Insurance: It is a mandatory condition of booking a tour with Touchgeorgia that all clients purchase comprehensive travel insurance covering cancellation, medical expenses, emergency evacuation, personal accident, and loss of baggage.
• 7.2. Proof of Insurance: Clients must provide proof of valid travel insurance upon request. If a client chooses to travel without comprehensive insurance, they do so at their own risk, and Touchgeorgia is not liable for any costs or losses incurred.
8. Documentation
• 8.1. Client Responsibility: Clients are solely responsible for ensuring they possess all necessary travel documents, including a valid passport, visa (if required for entry into Georgia), and any necessary vaccination or health certificates. Failure to possess required documents resulting in denied entry or cancellation is not the responsibility of Touchgeorgia, and cancellation charges will apply.
9. Governing Law
• 9.1. Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Georgia (Country). Any dispute arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Tbilisi, Georgia.
